This Privacy Policy describes how The Douglas County Museum Foundation, an Oregon domestic non-profit corporation (“DCMF,” “us,” “our,” or “we”), collects, uses, and protects your personal information when you use or access our website(s), application(s), and any related programs or services we offer (collectively, “Services”). This Privacy Policy also describes how we share certain information with third parties and what you can do to control the use, collection, and sharing of your personal information. This Privacy Policy applies to all use or access of our Services and all information provided to us (whether by phone, email, or through the use of and registration for our Services), but does not apply to third parties’ sites or services that may be linked to or otherwise available through our Services. By using our Services and providing information to us (including personally identifiable information), you are agreeing to this Privacy Policy.
1. Changes to this Policy
We encourage you to visit and review this Privacy Policy from time to time. We reserve the right at any time to change any portion of this Privacy Policy. If we make changes to this policy, we post an updated version with a new effective date. We will not, however, retroactively change how we share your personal information without your consent. We will provide notice of any material changes we deem appropriate before they take effect. If you do not agree to the updated terms, you are not authorized to use or access our Services.
2. Information We Collect
When you submit information to DCMF through our Services, or otherwise correspond or interact with us, DCMF receives and stores information about you, including personally identifiable information. Personally identifiable information (“Personal Information”) includes any information that could reasonably be used to personally identify you, including without limitation: your name, email address, shipping or billing address, social media account information, phone number, date of birth, location, and transaction-related information including payment or credit card information (if you donate to us, make purchases or submit other fees or payments). Depending on how you use our Services, you may be asked to provide us Personal Information when filling out online forms, including, but not limited to, registration forms, membership purchases and renewals, program and event registrations, newsletter and mailing lists, contact requests, and donation forms, when setting up an account, uploading content, and other activities.
When you visit our website or otherwise use our Services, we also automatically receive and may record certain information that your web browser provides, such as: your web request, IP address, browser type, browser language, referring/exit pages and URLs, platform type, domain names, type of device and operating system, pages, and information about your usage and interaction with our Services. Please remember that the privacy policies and practices of third parties govern your use of their products and services.
In addition, DCMF may use cookies, web beacons, or other similar technologies to record session identification such as browser type, pages, and information about your use and interaction with our Services. Please note that if you disable cookies in your browser settings, you may not be able to use all of our Services’ features. Similarly, web beacons (also known as clear gifs) may be used to track the online usage patterns of our users. The use of cookies by our partners, affiliates, tracking utility company, and/or service providers is not covered by our Privacy Policy. We do not have access or control over those cookies.
If you consent to our use of your geo-location, your device will transmit your location information to us while the application is running and may be used to provide you with information. If you use our single-sign-on functionality or use any social media platforms in connection with our Services (or any similar mechanism), we may collect personal information that you make available to us through those social media platforms, including, without limitation, your personally identifiable profile and account information. Please remember that the privacy policies and practices and terms of service of third parties govern your use of their products and services.
3. How DCMF Uses Your Personal Information
DCMF may use your Personal Information to: (1) allow you to use our Services and to improve your user experience with our Services; (2) to register your information for payment or donation processing, registration; (3) to protect the security of the Services; (4) to fulfil any order, purchase, request, or donation; (5) to respond to you or provide you with information you request; and (6) to provide product support, updates, customer services, and to comply with legal requirements.
The non-identifying information that we collect may be used to improve our Services by providing us information about the number of users, the types of technology used, and to detect any problems with how our Services work. Also, if you enable push notifications from our mobile applications, we may store information about your mobile device in order to send you notifications as a part of our Services.
4. Payment Processing
Depending on how you use our Services, you may provide us with credit card, payment, and billing information, including, without limitation, payment methods, subscriptions, billing addresses, credit card numbers, expiration dates, and security codes. Although we collect credit card and payment information, none of that information is stored by DCMF and is instead processed by a third-party processor. Payment processing is subject to the third-party processor’s terms and conditions.
5. Third Parties Providing Services on Our Behalf
Except as provided in this Privacy Policy, we do not sell, rent, swap, or authorize any third party to use your email address or other personal information without your permission. With your consent, we may share personal information with third parties. We also engage third-party service providers within our Services and we may share information with those third-party service providers. The information we receive from such service providers is subject to this Privacy Policy.
Information you provide to third-party service providers is subject to the specific service providers’ privacy policies and practices. In particular, we use a third-party for processing payments made by you through the various payment portals that exist as a part of our Services. We strongly encourage you to familiarize yourself with any third-party provider’s practices and policies before using their products or services. We may also share non-personally identifiable information (or de-identified information) in bulk with advertising, marketing, or other business relations, if any, for analysis of our Services. We may use this anonymous and aggregated analytics information for a variety of reasons, such as creating reports on usage trends and efficiency metrics.
6. Administrative and Legal Reasons.
We will disclose your personal information when we are required to do so by law or if we believe, in good faith, that such disclosures are required to: (1) comply with the law or with legal process; (2) enforce any legal agreements between you and us, including without limitation, our rules for your use of our Services; (3) protect your safety or security; (4) protect the safety or security of DCMF, our Services, our property, or our employees; or (5) protect the safety or security of any third party. Among other things, this means that if you provide false information or attempt to pose as someone else, information about you may be disclosed as part of any investigation into your actions.
7. Business Transfer
In the event that we ever merge with or are acquired by another company, we may transfer your information to that company.
8. Changing, Correcting, or Updating Your Information
You can obtain access to the personal information we currently have on file for you and/or correct inaccuracies in such personal information by making a written request to DCMF by mail or email to the addresses contained in the Contact page. Some of the third-party providers we use may allow you to update your personal information through your user account. We will correct or remove inaccurate information as requested as long as we do not need to retain the information for legitimate business or legal purposes. We also reserve the right to verify whether the information is correct. For your protection, you may be asked to provide additional information to verify your identity before being granted access to your personal information.
You may be able to opt-out of the cookies delivered by our Services by changing the settings on your internet browser, however, disabling cookies may substantially limit your ability to interact or access our Services. You may also disable the geo location function for our mobile application or delete our mobile application altogether through your device settings. If you have questions about your device, please contact the manufacturer directly.
9. Children
Our Services are not directed to individuals under the age of 13, and we do not knowingly collect personally identifiable information from children under age 13. If you are under age 13, you are not authorized to use or access our Services. If we discover that we have received any personal information from a child under the age of 13, we will delete that information immediately. 10. Our Communication Policy
We comply with applicable law and will not send you marketing messages if you have opted out or unsubscribed. We will not share, sell, rent, or authorize any third party to use your email address for commercial purposes without your permission. However, if you upload or otherwise share email addresses or contact information, you are representing and warranting to DCMF that you have the appropriate permission to upload or share such information.
DCMF reserves the right to send you communications related to your account status and notifications about significant changes to this Privacy Policy or your use of our Services. We may also use your email address to respond to any email from you. Please be aware that if you send us an email, the information disclosed in your email may not be secure and that we may collect and archive any communications from you. We suggest that you avoid sending highly personal or confidential information to us via email.
11. How We Protect Your Information
We protect the security of your information through use of commercially reasonable security features. We also use SSL security when transmitting certain sensitive information. Of course, no security system is perfect and we do not guarantee that your information is absolutely safe or that information you transmit will not be intercepted.
Also, we internally restrict access to your personal information to our employees, agents, subcontractors, or other personnel who need to know that information in order to provide you the goods or services offered through our Services. We do not share, rent, or lease your personal information to third parties not otherwise referenced in this policy. Keep in mind, however, that our Services allow you to provide personal information directly to third parties. This Privacy Policy does not govern the security of personal information that you provide to third parties.
12. “Do Not Track” Signals
We do not respond to browser based “do not track” settings or signals at this time.
13. Shine the Light
Under California Civil Code Sections 1798.83-.84, California residents are entitled to ask for a notice identifying the categories of personal customer information that we share with our affiliates and/or third parties for marketing purposes, and providing contact information for such affiliates and/or third parties.
